Terms and conditions for using PetBG Journal

Acceptance of Terms

By accessing or using the PetBG Journal mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the App. The App is developed and operated by Fil​ipp She​sta​kov (“we”, “us”, “our”).

Medical Disclaimer

IMPORTANT: PetBG Journal is a tracking tool designed to help you record and monitor your pet’s glucose readings, insulin doses, and related health data. The App is not a medical device, not a diagnostic tool, and is not a substitute for professional veterinary care.

You must always consult your veterinarian for all medical decisions regarding your pet’s health, including insulin dosing, dietary changes, and treatment plans. Do not delay seeking veterinary care based on information or data from the App.

The App’s accuracy depends entirely on the correctness of the data you enter. We make no warranties about the accuracy, reliability, or completeness of the App’s features or calculations. We are not liable for any medical outcomes, health complications, or veterinary emergencies resulting from your use of or reliance on the App.

PetBG Journal is intended for tracking purposes only - it is a tool to support, not replace, the care provided by your veterinarian.

Description of Service

PetBG Journal is a personal pet health tracking application designed for iOS devices. The App allows you to:

  • Log glucose readings for diabetic pets (dogs and cats)
  • Track insulin doses and medication schedules
  • Record weight measurements over time
  • Visualize trends with charts and analytics
  • Export data as CSV for sharing with your veterinarian (premium feature)

All data is stored locally on your device. Premium features are available via in-app subscription.

User Responsibilities

You are responsible for:

  • Accurate data entry: Ensuring all glucose readings, insulin doses, and other health data you enter are correct
  • Secure device: Protecting your device with a passcode, Face ID, or Touch ID to prevent unauthorized access to your pet’s health data
  • Backup your data: Using the CSV export feature (premium subscription) to create backups if desired
  • Follow veterinary guidance: Always consulting your veterinarian for medical decisions regarding insulin dosing, diet changes, or treatment adjustments
  • Report app issues: Contacting support@petbg.app if you encounter bugs, errors, or unexpected behavior

You acknowledge that the App is a tracking tool and that you remain solely responsible for your pet’s medical care decisions.

Subscription Terms

Free Tier

The App offers a free tier that includes:

  • Unlimited glucose entry logging
  • Entry history viewing
  • Basic glucose thresholds
  • Manual entry with insulin and weight tracking
  • Settings management

Premium Tier

Premium subscription includes:

  • CSV import/export (backup and restore all data)
  • Medication schedule (custom injection time slots with quick entry)
  • Extended features and functionality

Auto-Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation

You can cancel your subscription at any time via App Store Subscriptions:

  1. Open iOS Settings
  2. Tap your name → Subscriptions
  3. Select PetBG Journal → Cancel Subscription

Cancellation takes effect at the end of the current billing period. You will retain premium access until that date.

Payment

All payments are processed by Apple through the App Store. We do not store or process credit card information. Your payment method will be charged by Apple.

Refund Policy

All subscription purchases are governed by Apple’s App Store refund policy. We cannot process refunds directly.

Refunds are at Apple’s discretion and subject to their terms and conditions.

Intellectual Property Rights

The App, including its code, design, graphics, user interface, features, and content, is proprietary and owned by Fil​ipp She​sta​kov. All rights are reserved.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes only. This license does not transfer any intellectual property rights to you.

You own your pet’s health data. All glucose readings, insulin doses, notes, and other health information you enter into the App belong to you. We claim no ownership or rights to your pet’s health data.

You may not:

  • Copy, modify, or create derivative works of the App
  • Reverse engineer, decompile, or disassemble the App
  • Remove or alter any copyright, trademark, or proprietary notices
  • Use the App for any commercial purpose without written permission

Limitation of Liability

NOT LIABLE FOR MEDICAL DECISIONS: We are not liable for any medical decisions, veterinary treatment outcomes, health complications, or adverse events resulting from your use of the App or reliance on data tracked in the App.

PROVIDED AS-IS: The App is provided “as is” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

MAXIMUM LIABILITY: To the maximum extent permitted by law, our total liability to you for any claims arising from your use of the App is limited to the amount you paid for your subscription (if any) in the 12 months preceding the claim. For free tier users, our maximum liability is $0.

NO LIABILITY FOR DATA LOSS: We are not liable for data loss, corruption, or deletion. You are responsible for backing up your data using the CSV export feature.

JURISDICTION DISCLAIMER: Some states, provinces, or countries do not allow limitations on implied warranties or exclusions/limitations of certain damages. In such jurisdictions, the above limitations may not apply to you, and our liability will be limited to the maximum extent permitted by law.

User Conduct

You agree not to:

  • Reverse engineer or attempt to extract the source code of the App
  • Misuse or abuse App features, including attempting to bypass subscription checks or access premium features without payment
  • Share subscription credentials or transfer your subscription to another user
  • Automated scraping or use bots, scripts, or automated tools to access the App
  • Use the App for any unlawful purpose or in violation of these Terms

Violation of these prohibitions may result in immediate termination of your access to the App, without refund.

Termination

We reserve the right to terminate or suspend your access to the App at any time, with or without notice, for:

  • Violation of these Terms
  • Abuse of App features or subscription system
  • Fraudulent activity (e.g., payment disputes, chargeback abuse)
  • Any conduct we deem harmful to the App or other users

Upon termination, your right to use the App and access premium features will immediately cease. Refunds for terminated subscriptions are at our sole discretion.

Changes to Terms

We may update these Terms from time to time to reflect changes in the App, legal requirements, or business practices. When we make changes, we will:

  • Update the “Last Updated” date at the top of these Terms
  • Notify you via in-app notification when you next open the App
  • For material changes, provide 30 days’ notice before the changes take effect

Your continued use of the App after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the App and cancel your subscription.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

Informal Resolution First: If you have a dispute, concern, or complaint regarding these Terms or the App, please contact us at support@petbg.app first. We will make a good-faith effort to resolve the matter informally.

Arbitration/Mediation: If informal resolution is unsuccessful, disputes may be resolved through arbitration or mediation under German law.

Jurisdiction: Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of Germany.

Consumer Protection: Nothing in these Terms affects your rights as a consumer under applicable consumer protection laws in your jurisdiction.
